Instructions for Adopted Filing

Download the appropriate forms (APA Forms). Each filing received by the Office of the Secretary of State must include original signatures, and shall arrive no later than 3:30 p.m. on Friday to allow for processing of the rule. When filing multiple rules please allow extra time for processing.

Adopted Rule Filings require the following forms and must be filed with both the Office of the Secretary of State and the Legislative Committee on Administrative Rules (LCAR).

In additional to the forms, a clean text of the rule is required. Properly adopted rules shall take effect 15 days after the adopted filing is received (see 3 V.S.A. § 845(d) for details) unless a later date is specified in the text of the rule, or on the adopting page of the filing.

Upon receipt, the Office of the Secretary of State will assign an adopted rule number and issue and send by mail a memo to the contact person indicated on the coversheet, and a copy of the memo to LCAR. The memo contains information about the rule filing (i.e. rule number assigned upon entry of the rule in the tracking database, date of receipt, publication dates, any problems encountered with the rule filing).

A copy of the adopted rule will be forwarded to the publisher to be added to the Code of Vermont Rules.
