Instructions for Final Proposed Filing
Download the appropriate forms (APA Forms). Each filing received by the Office of the Secretary of State must include original signatures, and shall arrive no later than 3:30 p.m. on Friday to allow for processing of the rule. When filing multiple rules please allow extra time for processing.
Final Proposed Rule filings require the following forms and must be filed with both the Office of the Secretary of State and the Legislative committee on Administrative Rules (LCAR).
The additional forms listed below may be necessary if an agency relies upon scientific information for the validity of their rule and/or if an agency is incorporating extraneous material (i.e. federal regulations/standards) by reference. When incorporating by reference a copy of the material being incorporated must accompany the filing.
In addition to the forms, copies of written comments submitted during the notice and comment period, a responsiveness summary, and a letter explaining any changes made from the proposed rule, a clean text of the final proposed rule, an annotated text and a copy of the ICAR approval memo are also required with the Final Proposed Rule filing.
Note: Comprehensive revisions require annotated text, and are considered amendments. Rules that have not previously existed in any form are considered new rules and do not require annotate text. Annotate text should clearly denote any changes (i.e. by strikethrough and underlining).
The Office of the Secretary of State will issue and send by mail a memo to the contact person indicated on the coversheet, and a copy of the memo to LCAR. The memo contains information about the rule filing (i.e. rule number assigned upon entry of the rule in the tracking database, date of receipt, publication dates, any problems encountered with the rule filing etc.).
