Quarterly Escrow Deposit and Certification Requirement

Vermont Proposed Rule: 04P020 

AGENCY: Attorney General's Office 

CONCISE SUMMARY: This rule establishes criteria and procedures for requiring certain tobacco manufacturers who have not joined the Master Settlement Agreement ("nonparticipating manufacturers," or "NPMs") to make their required escrow payments on a quarterly basis rather than annually to promote compliance with Vermont's Nonparticipating Tobacco Manufacturers Act, 33 V.S.A. Chapter 19, Subchapter 1A ("NPM Statute") 

TYPE OF PERSONS AFFECTED: (1)Nonparticipating tobacco manufacturers who will be required to make quarterly payments; (2) The attorney General's Tobacco Unit; and (3)Vermont consumers who may in the future by entitled to compensation from the reserve funds created by the escrow payments. 

COST BENEFIT ANALYSIS: This rule will help assure that Vermont consumers who suffer harm from health conditions caused by cigarette smoking will have a source of recovery for their injuries by reducing the number of cigarettes sold in Vermont for which no escrow payments are made.  The rule has a minimal administrative impact on the NPMs who will have to make quarterly payments rather than one annual payment, and a minimal administrative impact on the Attorney General's Office which must monitor compliance.

Business Entity Limited Lines Producer License for Rental Car Insurance, Revised

Vermont Proposed Rule: 04P021 

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration 

CONCISE SUMMARY: The purpose of the rule is to amend Regulation I-2002-02, Business Entity Limited Lines License for Rental Car Insurance.  The regulation requires an insurance producer to be designated to oversee the operations of the limited lines business entity. The proposed rule will replace an insurance producer licensee with a limited lines producer licensee to oversee the business entity. 

TYPE OF PERSONS AFFECTED: This regulation will affect rental car companies; the Department of Banking, Insurance, Securities and Health Care Administration, and Vermont rental car consumers. 

COST BENEFIT ANALYSIS: This rule should have a minimal economic impact. 

SCHEDULED HEARINGS: Tuesday, April 29, 2004, at 10 am in the Large Conference Room on the second floor, at the Vermont Department of Banking, Insurance, Securities and Health Care Administration.
