PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Use of State Controlled Fishing Access Areas.
Vermont Proposed Rule: 06P011
AGENCY: Natural Resources, Fish & Wildlife Dept.
CONCISE SUMMARY: This rule regulates the use of state controlled fishing access areas. It implements the policy found in 10 V.S.A. § 4145(a) authorizing use by all vessels registered in Vermont and the ancillary use by vehicles and trailers associated with those vessels. It authorizes the use by non-motorized vessels not used for commercial purposes and their vehicles and trailers. It establishes a priority of uses. It allows for limited commercial or group use by permit to prevent adverse impact on the priority uses. It prohibits activities that have an adverse impact on authorized uses.
TYPE OF PERSONS AFFECTED: Anglers, hunters, trappers, power boaters, sailors, kayakers, canoeists, guides, canoe and kayak outfitters, visitors, the Department of Tourism and Marketing and the Department of Fish and Wildlife.
COST BENEFIT ANALYSIS: There is currently no direct user fee for using fishing access areas. They are funded by Vermont fishing license sales, federal excise taxes on fishing equipment, federal excise tax on marine motor fuels, and the Vermont motorboat registration fund. They are popular with residents and visitors alike so existing indirect economic benefits are expected to continue. If uses of access areas increase, then maintenance expenses are expected to increase also. There may also be some increased enforcement expenses.
SCHEDULED HEARINGS: To be corrected for compliance with statute.
DEADLINE FOR PUBLIC COMMENT: April 27, 2006 at 7:00 PM at the Georgia Elementary and Middle School, 4416 Ethan Allen Highway in St. Albans, Vermont and May 2, 2006 at 7:00 PM in Rutland at the Rutland Intermediate School Library Avenue, Rutland Vermont.
