Graduated Sanctions for Probation Violations.

Vermont Proposed Rule: 06P012 

AGENCY: Human Services, Dept. of Corrections 

CONCISE SUMMARY: This rule establishes guidelines for Corrections' staff to support successful completion of probation for offenders prior to requesting judicial intervention; and to offer the Judiciary graduated sanction guidelines to consider in violation of probation proceedings. 

TYPE OF PERSONS AFFECTED: All DOC staff and contractors; Corrections Joint Legislative Oversight Committee; Office of the Attorney General; Department of Public Safety, State's Attorneys and Sheriffs' Association; the Judiciary; the Defender General, Prisoners' Rights Office, VT Protection & Advocacy, offender advocates; Center for Crime Victim Services, Network Against Domestic and Sexual Violence; Corrections' Advisory Board; business owners; community-based organizations providing services to offenders; and offenders and their families. 

COST BENEFIT ANALYSIS: This rule formalizes and provides the opportunity for more consistent use of graduated and alternative sanctions both within the Department of Corrections and if utilized, within the Judiciary.  Standard use of lesser interventions by Corrections staff for non-risk related violations prior to bringing judicial intervention may reduce the burden on court resources.  There may also be a reduction in the use of legal resources, both prosecutors and defense attorneys. The use of standardized guidelines for graduated sanctions as part of judicial decision-making has the potential to reduce the use of incarceration as a violation sanction. Using restorative alternatives promotes stronger connections to the community for the offender and has the potential for greater social benefit.
