PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Livestock Premises Registration 

Vermont Proposed Rule: 06P016 

AGENCY: Agriculture, Food & Markets 

CONCISE SUMMARY: This rule addresses livestock premises registration (not individual animal identification).  Premises registration will facilitate more effective disease control and emergency response by being able to link farm locations with geographical coordinates.  These rules will define a premises as a geographical location on which livestock are kept.  The registration requirement under this rule will be implemented in a two-tiered process.  Livestock operations that sell product to the public will need to register within 6 months.  Those who keep livestock as a hobby or for personal use will need to register within one year.  Premises registration renewal will be required biennially, and will occur during regular licensing or registration processes.  There is no fee to register livestock premises.  A person may register on-line or in writing on forms provided by Vermont Agency of Agriculture, Food & Markets (VAAFM).  Forms will be readily available from the Agency. 

TYPE OF PERSONS AFFECTED: Farmers, livestock owners, livestock dealers, public health officials, fish and wildlife agencies, agency of agriculture employees. 

COST BENEFIT ANALYSIS: This rule will affect an estimated 8,000 Vermont agricultural businesses and hobbyists.  Affected businesses must register their premises with VAAFM.  Once registered, businesses must renew their premises registration biennially.  There is no registration fee.  Businesses can register on-line or in writing.  Some businesses currently licensed by VAAFM, including cervid farms, animal markets, animal dealers, animal truckers, slaughter establishments, equine quarantine facilities and rendering establishments, can comply by completing a form as part of the business licensure.  This rule does not create any new record keeping or reporting requirements, other than the basic registration requirement.  It does not require businesses to hire any new professional services.
