Changes to Reach Up Income, Resource, and Work Activity Rules.

Vermont Proposed Rule: 06P019

AGENCY: Dept. for Children and Families (DCF)

CONCISE SUMMARY: This bulletin proposes to revise Reach Up Program income, resource, and work activity rules as required by Acts 113 and 215, enacted by the Vermont General Assembly in 2006, and the federal Deficit Reduction Act of 2005 (DRA). Under the proposed rules, cash contributions for medical support paid to a Reach Up family by a noncustodial parent and assets accumulated from federal and Vermont earned income tax credits will be excluded for purposes of determining eligibility for Reach Up financial assistance. In addition, work activities will be aligned with federal requirements while ensuring that Reach Up rules maximize opportunities for countable participation in activities. Financial literacy classes will be added as a work activity, but only to the extent permitted by federal law and regulations.

TYPE OF PERSONS AFFECTED: Families receiving Reach Up financial assistance, Vermont Department for Children and Families (DCF).

COST BENEFIT ANALYSIS: Reach Up data for calendar year 2005 show no financial assistance grant closures due to receipt of earned income tax credits (EITC). Elimination of Reach Up income and resource rules that provide for closure of benefits in some circumstances due to receipt of EITC is, therefore, expected to be cost neutral with an estimated fiscal impact of $0. Custodial parents are not currently receiving cash medical support. When they do receive it, the department will exclude it as income. The effect of this rule change is, therefore, also expected to be cost neutral with an estimated fiscal impact of $0.
