PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Regulations for the Designation and Operation of Home Health Agencies.

Vermont Proposed Rule: 06P020

AGENCY: Human Services, Dept. of Disabilities, Aging and Independent Living (DAIL)

CONCISE SUMMARY: The purpose of the rule is to establish a regulatory system for the designation and operation of home health agencies to ensure that every person in every town in Vermont who needs home health services will have access to comprehensive, medically necessary, high quality home health services, without regard to ability to pay, delivered in an efficient and cost-effective manner based on a model that promotes cooperation and non-duplication of services, rather than unregulated competition.

TYPE OF PERSONS AFFECTED: All Vermonters who need and want to receive community-based home health services, the thirteen home health agencies, the State Long-Term Care Ombudsman, The Vermont Assembly of Home Health Agencies, the Area Agencies on Aging, to some extent, and the Vermont Department of Disabilities, Aging and Independent Living.

COST BENEFIT ANALYSIS: There will be increased administrative costs for the home health agencies, the Department and the Ombudsman program.The Legislature appropriated funds for two FTE positions for the State LTC Ombudsman and one FTE position for the Division of Licensing and Protection in order to meet the requirements of the statute and rule. According to information provided by the home health agencies, there will be a modest cost to comply with the rule for the agencies, including staff time associated with annual quality assurance reviews.

SCHEDULED HEARINGS: Friday, September 1, 2006, 1:30 p.m. to 3:30 p.m. in Stanley Hall, Room 100, State Office Complex, Waterbury, Vermont. Please notify the Department by August 18, 2006 if any special accommodations (including a sign language interpreter) are needed for the public hearing.
