Furbearing Species.

Vermont Proposed Rule: 06P022

AGENCY: Natural Resources, Fish & Wildlife Dept.

CONCISE SUMMARY: The goal of this rule change is to consolidate eleven existing regulations under one heading: "Furbearing Species". This change will simplify public use and understanding of the regulations and minimize the expense and complexity involved in future regulatory modifications.  In addition, enforcement ambiguities will be clarified and wherever possible language simplified.  The beaver season will be expanded from December 1 to the fourth Saturday in February to December 1 to March 31st.

TYPE OF PERSONS AFFECTED: Vermont trappers, the Fish and Wildlife Department

and the US Department of Agriculture, APHIS, Wildlife Services.

COST BENEFIT ANALYSIS: This rule change should decrease the cost of future modifications to the furbearer regulations. There will no negative economic impact to the public.

SCHEDULED HEARINGS: None scheduled at this time but one will be held if requested.

Control of Hazardous Air Contaminants.

Vermont Proposed Rule: 06P023

AGENCY: Natural Resources, Air Pollution Control

CONCISE SUMMARY: Vermont regulates emissions of hazardous air contaminants (HACs) from stationary sources under § 5-261 of the Air Pollution Control Regulations. Appendix B of the regulations lists the HACs, and Appendix C establishes a hazardous ambient air standard (HAAS) and an action level (AL) for each HAC.  Appendix C also categorizes HACs, based on their toxicity: Category I (known or suspected carcinogens), Category II (chronic systemic toxicity due to long-term exposure), and Category III (short-term irritant effects).  The proposed rule amendments will update the HAAS, AL, and/or toxicity category for many HACs in Appendix C and revise Appendix D, which contains the methodology for deriving a HAAS. These revisions are being proposed to ensure that the standards are protective of human health.  In addition, other revisions to related provisions of the regulations are being made to bring them up-to-date and to delay the implementation of the propose amendments to Appendix C with respect to registration fees.

TYPE OF PERSONS AFFECTED: Industries and activities which may emit hazardous air contaminants to the atmosphere; persons residing in the vicinity of such industries or activities; environmental and public health groups; state and local agencies with an interest in public health.  For example: Associated Industries of Vermont, Barre Granite Association, Vermont Petroleum Institute, Automobile Manufacturers Association, Vermont Public Interest Group, Conservation Law Foundation, Vermont Natural Resource Council, Agency of Natural Resource, Department of Health, to name a few.

COST BENEFIT ANALYSIS: By updating the HAAS for HACs based on current toxicological information, the standards will be up-to-date and protective of human health. Reductions in health care costs and lost wages will be realized by individuals and society due to decrease concentrations of HACs. It is anticipated that the revised rule will impose an economic impact on some businesses in VT that emit toxic air pollutants.  Facilities that emit more than 5 tons of pollutants per year must register their emissions with the Air Pollution Control Division and pay a fee for any HAC emissions; the fee depends on the toxicity category of the emitted HAC.  With the adoption of the proposed rule amendments, the toxicity category of many HACs will be revised to be more, or in some instances less, stringent.  Consequently, the fees for emissions of HACs for some facilities may increase.
