Rules for the Administration and Collection of the Employers' Health Care Contribution.

Vermont Proposed Rule: 06P027

AGENCY: Dept. of Labor

CONCISE SUMMARY: This rule establishes an administrative process by which an employer may calculate and remit his or her quarterly health care premium contribution. This contribution is mandated by Act 191 of the 2006 Vermont General Assembly, and is intended to provide a funding source for the Catamount Health Plan. The contribution is assessed based on the number of an employer's employees, in excess of 8, who are not offered health care coverage by the employer, as well as those who decline coverage and are otherwise uninsured. The quarterly contribution rate is $91.25 per full time employee. This rule will take effect in the second quarter of 2007.

TYPE OF PERSONS AFFECTED: All employers with more than 8 employees who either do not offer health care coverage to their employees, or who do offer health care coverage but have 8 or more employees who decline health care coverage and are otherwise uncovered. As of July 1, 2008, the number of employees drops to 6, as of July 1, 2009, the number drop to 4.

COST BENEFIT ANALYSIS: The obvious economic impact of the rule is quantifiable at $365.00 a year per uncovered employee in excess of 8. This is statutorily mandated. There will be a minor ancillary cost to an employer, primarily for maintaining records of whether their employees have health coverage from other sources. Reporting to the Department will be done on an existing unemployment insurance reporting form, which will need to be altered slightly. The rule will have a proportionally greater impact on employers who do not offer health care coverage, or who offer minimal coverage.
