By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Act 250 Rules (2006 Amendments)

Vermont Proposed Rule: 06P038

AGENCY: Natural Resources Board: Land Use Panel

CONCISE SUMMARY: The proposed rules (a) define "construction of improvements" to not include "home occupations;" (b) define "home occupations;" (c) define "the farm" and "principally produced," as those terms are used in 10 V.S.A. § 6001(22)(E); (d) define "shoreline" and "of necessity," as those terms are used in 10 V.S.A. § 6086(a)(1)(F); (e) define "rural growth areas," as that term is used in 10 V.S.A. § 6086 (a)(9)(L); (f) repeal Rule 3(B) to eliminate redundancy and inconsistency with the statute; (g) allow District Commissions to elect vice chairs and acting chairs (Rule 18(B) and (C); (h) make technical corrections to Rule 19(I); (i) clarify Rule 34(E) (Stowe Club Highlands test); and (j) implement the changes to the primary agricultural soils provisions effectuated by Act 183(2006).

TYPE OF PERSONS AFFECTED: Lawyers, engineers, architects, consultants, state and local officials and all persons and governmental agencies who apply for Act 250 permits and who participate in Act 250 proceedings before the District Commissions and the Environmental Court.

COST BENEFIT ANALYSIS: It is not anticipated that these proposed rules will have any direct or indirect negative economic impact on the citizens of the State.
