Standard Protocol and Procedures for Initiating and Dispensing Emergency Contraception by Pharmacists

AGENCY: Human Services, Department of Health
CONCISE SUMMARY: The rules establish procedures by which pharmacists who are in collaborative practice with prescription-authorized medical professionals can initiate and dispense emergency contraceptives to women.
TYPE OF PERSONS AFFECTED: Pharmacists who wish to become involved in a voluntary program for emergency contraception, Board of Pharmacy, women who may be in need of emergency contraception, Department of Health, family planning organizations, medical prescribers (doctors, nurse practitioners, physician assistants).
COST BENEFIT ANALYSIS: None, other than the time which pharmacists and medical professionals wish to devote to collaborative practices for this limited purpose.

Captive Insurance Companies Reinsuring Life Insurance Policies
Vermont Proposed Rule: 06P040
AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration
CONCISE SUMMARY: The proposed regulation sets forth reserve requirements and the form of the annual report required of a captive insurance company that reinsures life insurance policies, including term, universal and variable life policies, and related guarantees and riders. A captive insurance company completes its annual report to BISHCA based on GAAP accounting principles, unless the Commissioner approves the use of statutory accounting principles. The rule specifies the form of annual report to be used, which depends on the accounting method the captive uses. The rule also requires that the captive maintain adequate reserves for its insurance obligations. The rule would apply with respect to fiscal years ending on and after December 31, 2005, but such application would not require any captive insurance company to amend or change its annual reports filed for the 2005 and 2006 fiscal years.
TYPE OF PERSONS AFFECTED: The proposed rule will affect captive insurance companies that reinsure life insurance policies with respect to the type of annual report they file with BISHCA. BISHCA is the only governmental entity that will be affected by this rule.
COST BENEFIT ANALYSIS: Currently, Vermont and South Carolina are the two leading captive insurance domiciles competing for captive insurers reinsuring life insurance policies. The proposed rule will facilitate the formation and operation of these captive insurance programs in Vermont. This will provide the State with additional premium tax revenues. Such programs will also support Vermont-based accounting, legal, actuarial and insurance business that provide support services to captive insurance companies. The rule will not increase the cost to BISHCA or any other state agency of regulating such captive insurance programs. The rule will not cause any additional cost or expense to such captive insurance companies.
