PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Emergency Assistance Rental or Mortgage Arrearage Assistance.
Vermont Proposed Rule: 06P041
AGENCY: Dept. for Children and Families (DCF)
CONCISE SUMMARY: This bulletin proposes changes in Emergency Assistance (EA) rental or mortgage arrearage assistance rules required by Act 215, enacted by the Vermont General Assembly in 2006. Under the proposed rules Category I an II distinctions and eligibility criteria are eliminated, eligible families may receive up to three months of arrearage assistance within a 12 month period. Proposed rules add eligibility criteria related to disability, housing expenses greater than 60 percent of family income, and cost effectiveness related to potential need for temporary housing.
TYPE OF PERSONS AFFECTED: Families applying for Emergency Assistance Program rental or mortgage arrearage assistance, landlords, mortgage holders, Vermont Department for Children and Families (DCF).
COST BENEFIT ANALYSIS: Although Category II arrearage assistance (formerly known as "no good cause" will be eliminated, some of the families that would have received assistance an additional potential month of eligibility as well as availability once a year rather than once every three years. Some families that would have been ineligible under current rules may be eligible or that grants are larger under the new rules, the total spending cannot be more than the appropriation, which has not changed since SFY 2004. The effect of this rule change is, therefore, expected to be cost neutral with an estimated fiscal impact of $0.
