Rules Governing Inspection of Motor Vehicles.
Vermont Proposed Rule: 06P042
AGENCY: Transportation, Dept. of Motor Vehicles
CONCISE SUMMARY: The rule adopts the standards by which motor vehicles of different types are inspected for compliance with equipment and safety requirements. It describes what must be inspected, gives some guidance in how to inspect and sets pass / fail criteria to help ensure all vehicles meet a minimum standard.
TYPE OF PERSONS AFFECTED: Inspection Stations, Inspection Mechanics, Department of Motor Vehicles and vehicle owners / lessees.
COST BENEFIT ANALYSIS: None - The proposed rule is to update the existing rules by adding information brought about by passage of legislation over the last few years, adding some additional general information, removing antiquated information that is no longer used, adding instructions for inspecting additional reconstructed and special motor vehicle types and adding a chapter on the inspection of flaps and fenders.

Notice For Public Review And Comment
Proposed Memorandum of Understanding
Between The Vermont Agency of Natural Resources
and
The Vermont Agency of Agriculture, Food and Markets.
Act 78 of the 2005 Legislative Session, directs the Agency of Natural Resources (ANR) and the Agency of Agriculture, Food and Markets (AAF&M) to develop a Memorandum of Understanding regarding the implementation of the Federal Clean Water Act Concentrated Animal Feeding Operation (CAFO) program and the relationship between the federal CAFO program and the State agricultural water quality requirements for large farm operations (LFOs), medium farm operations (MFOs) and small farms under 6 V.S.A. Chapter 215 (Agricultural Water Quality).
Summary of Proposal
Sections 301 and 502 of the federal Clean Water Act (33 USC §§ 1311 and 1362[14]) mandate the regulation of point source discharges from CAFOs by requiring that CAFOs obtain and comply with Clean Water Act National Pollutant Discharge Elimination System (NPDES) permits.
ANR's Department of Environmental Conservation is the designated water quality agency responsible for management and enforcement of water pollution control statutes and pursuant to Section 402[b] of the federal Clean Water Act, 33 USC § 1342[b], is the delegated Clean Water Act NPDES permitting authority in Vermont.
AAF&M implements and enforces Vermont’s LFO, MFO and Accepted Agricultural Practice (AAP) programs as State agricultural water quality programs which are each separate and distinct from the federal CAFO NPDES program.
The Legislature has directed AAF&M and ANR to coordinate and consult with each other with respect to LFO and MFO permitting, to protect water quality by reducing and eliminating agricultural non-point source pollutants and point source discharges from MFOs and LFOs. The Legislature has also required all permits issued under the LFO and MFO programs to meet standards (addressing waste management, waste storage, the development of nutrient management plans, carcass disposal, surface water and groundwater contamination, recordkeeping, reporting and monitoring provisions) which are at least as stringent as those established by the EPA CAFO Rules.
The Memorandum of Understanding (MOU)describes program administration, permit issuance, an appellate process, enforcement authority and implementation for ANR’s CAFO program and AAF&M’s MFO, LFO and AAP programs. The MOU addresses the continued and efficient coordination and cooperation between ANR and AAF&M in achieving compliance by agricultural operators with Vermont’s water pollution control laws and agricultural water quality laws.
