Fishing

Vermont Proposed Rule: 08P002

AGENCY: Natural Resources, Fish & Wildlife Dept.

CONCISE SUMMARY: This is an amendment to existing regulation § 122, Section 5, governing the taking, possessing, transporting, use and selling of baitfish. Changes include: 1) Wild baitfish cannot be personally harvested, 2) Wild baitfish can be commercially harvested from L. Champlain and only sold for use there, 3) Baitfish sold commercially elsewhere in VT must originate from fish hatcheries approved by the Commissioner. 4) Bait dealers must issue, and anglers must carry a receipt of sale from a receipt book provided by the Department containing information such as: a unique receipt number, name of Bait Dealer, time and date of sale, species and quantity purchased, waterbody where bait will be used, signature of purchaser. 5) Anglers must not leave a waterbody with baitfish in their possession. 6) Upon being removed from the water, all boats, boat trailers, boating or fishing equipment, including water in any bilge, ballast tank, bait bucket, and live well must be immediately emptied and drained of all water.

TYPE OF PERSONS AFFECTED: Wild baitfish harvesters, Commercial baitfish dealers, anglers, Vermont Fish & Wildlife Department

COST BENEFIT ANALYSIS: All impacts listed are POTENTIAL, not a certainty: 1) Increased cost to anglers for farm-raised live bait. 2) Loss of business to Commercial Bait Dealers (CBD's) due to higher bait costs. 3) Loss of anglers and fishing license sales due to high costs. 4) Increased business to CBD's as anglers cannot harvest own bait. 5) Loss of anglers and fishing license sales if VHS spreads to Vermont and causes large fish kills and decreased fish populations, unsightly waters, hemorrhaged fish.

Supervision Fees for Offenders Under Field Supervision by the Department of Corrections.

Vermont Proposed Rule: 08P003

AGENCY: Human Services, Dept. of Corrections

CONCISE SUMMARY: The purpose of this administrative rule is to set standards for the Department of Corrections; assessment of offender payment of supervision fees, as required in statute. Collection of supervision fees will be used to offset some of the Department's cost of supervision fee up to $30 per month, as allowed by statute, from each offender under Department community supervision, unless the offender falls into a category as described in the rule which makes them exempt.

TYPE OF PERSONS AFFECTED: Offenders under community supervision by the DOC, their families, all DOC staff, victims of crime, and Center for Crime Victim Services.

COST BENEFIT ANALYSIS: The current rule only allows for a $0 or a $30 supervision fee. This rule will allow the Department of Corrections to collect form offenders under the Department’s supervision a monthly fee up to $30 per month. The economic impact on the offender will depend on their length of supervision and the level of the fee assessed. This will allow the department to increase the number of participants and will offset some of the cost associated with supervising inmates.

SCHEDULED HEARINGS: Two public hearings are scheduled: February 19, 2008, 2 - 4 pm, Chapel Conference Room, 103 South Main St., South Building Waterbury VT. and February 20, 2008, 1 - 3 pm, Burlington Probation and Parole Office, 32 Cherry St. Burlington VT.
