Administrative Rules for Nursing Home Administrators

Vermont Proposed Rule: 08P041

AGENCY: Secretary of State, Office of Professional Regulations

CONCISE SUMMARY: The rules reflect 2005 legislative changes in licensure by endorsement requirements, and the change from a board-governed to OPR Director (with Nursing Home Administrator advisors) governed profession. The rule addresses reinstatement of licenses which have lapsed for more than 5 years.

TYPE OF PERSONS AFFECTED: Licensed Nursing Home Administrators, applicants, and those who have been licensed and whose licenses lapse and who wish reinstatement.

COST BENEFIT ANALYSIS: There should be no economic impact on licensees or the public. Former licensees whose licenses have lapsed for 5 years and who wish reinstatement will have to take the licensing examination which at this time costs $285.

Administrative Rules of the Board of Public Accountancy

Vermont Proposed Rule: 08P042

AGENCY: Secretary of State, Office of Professional Regulations

CONCISE SUMMARY: The General Assembly required (see Act 29 (2007 Session)) that the Board of Public Accountancy initiate rulemaking to address the changing nature of the practice of the profession of public accountancy and to reflect current educational practices and licensing standards. These administrative rules reflect the General Assembly's directive. The primary changes pertain to educational and experience requirements for an applicant to become licensed on the basis of examination. The General Assembly changed the education requirement for licensees and the rules will reflect these statutory changes. The change was prompted to meet recommended national standards. Experience requirements were amended to more closely meet national standards and improve mobility for Vermont licensees. The proposed rules delete statutorily superseded provisions and terms including information regarding prior versions of the CPA examination procedures. Certain provisions throughout the document were clarified as to their intent.

TYPE OF PERSONS AFFECTED: Licensees, applicants and potential applicants, financial services industries, and the public.

COST BENEFIT ANALYSIS: The primary impact is on applicants and licensees. There will be costs for additional education required to sit for the national examination and/or to become licensed. The change in the increased educational requirements took effect with the statutory change in 2007. To date, there has been no discernable impact on the licensing activity due to the increased costs.
