5.100 Regulations Pertaining to Construction and Operation of Net Metering Systems for the Purchase and Sale of Electricity from Small Electrical Generating Systems to and from Electric Companies.

AGENCY: Public Service Board

CONCISE SUMMARY: This is an amendment to the existing rule governing the net metering process which is in turn based upon the statutory provisions of 30 V.S.A. Section 219a. The amendment incorporates the recent legislative changes made to 30 V.S.A. Section 219a. Specifically, these changes include a broader definition of what constitutes a net metering system, expands the definition of group systems, increases the capacity limit on systems to 250 kW, increases the utility net metered capacity limit to 2%, and sets forth an aesthetic review procedure for wind turbines and other systems. Expanding the program in this manner should provide additional opportunities and incentives for customers engaging in net metering and should not have a significant economic impact on utilities.

TYPE OF PERSONS AFFECTED: The existing rule directly affects electric utilities engaged in the operation of any electric transmission or distribution system, and companies engaged in the sale and installation of net metering systems. It also directly affects consumers of electricity who install net metering systems in the State of Vermont. The proposed amended rule will not change the entities affected by the existing rule.

COST BENEFIT ANALYSIS: Generally, the existing rule and the amendments to the rule significantly reduce the costs for all involved in the net metering process by establishing simplified procedures for application for and issuance of certificates of public good pursuant to 30 V.S.A. § 248, and by establishing technical specifications for interconnection that eliminate the need for individual interconnection agreements between the host utility and the net metering customer. The proposed amendments to the rule should have a minimal economic impact.
