By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Radiological Health

Vermont Proposed Rule: 09P010

AGENCY: Human Services, Department of Health

CONCISE SUMMARY: The proposed amendments update and clarify regulatory standards for control of ionizing radiation for occupational and public exposure to radiation from medical and industrial uses of radiation and for public exposure from licensed activities at the Vermont Yankee Nuclear Power Station (VYNPS). The proposed amendments would adopt the Department's current practices and procedures for oversight of ionizing radiation to assure the public health and safety, including the Department's independent monitoring of VYNPS to verify the plant's compliance with the limits established in the rule. The amendments specify the dose conversion factor to be used by VYNPS in determining compliance with the rule. The proposal retains the same strict maximum dose limits of the current rule that are one-fifth of the federal standards and the lowest in the country. The proposed amendments eliminate a number of provisions that are out-of-date and that are otherwise regulated by the Nuclear Regulatory Commission.

TYPE OF PERSONS AFFECTED: All persons living or working in proximity to VYNPS, Entergy Nuclear Vermont Yankee, LLC., ad Entergy Nuclear Operations, Inc.; Vermont e lectric utilities and consumers; Department of Health; Department of Public Service; Public Service Board; and owners, operators and workers in medical, industrial or other facilities and businesses that use or transport radioactive materials or equipment.

COST BENEFIT ANALYSIS: The rule clarifies existing procedures and retains existing standards and therefore it is expected that there should be no additional expense, as all regulated entities are currently required to conform to the current standards.

SCHEDULED HEARINGS: A public hearing will be held on March 9, 2009 from 6 - 9 pm at the Vernon Elementary School, 381 Governor Hunt Road, Vernon, Vermont.
