Health Care Stop Loss Insurance

Vermont Proposed Rule: 09P012

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: This rule will establish minimum attachment points for stop-loss insurance policies issued to self-funded group health plans and the process for approval of the forms and rates for such policies.

TYPE OF PERSONS AFFECTED: Issuers of health care stop loss insurance policies and purchasers of such policies.

COST BENEFIT ANALYSIS: The economic impact of this rule is minimal.

Rule 27.000 --- Mediation

Vermont Proposed Rule: 09P013

AGENCY: Dept. of Labor

CONCISE SUMMARY: The rule establishes a requirement that parties to a disputed workers' compensation (W.C.) claim attempt to resolve the dispute through mediation, prior to engaging in the time and expense of a formal administrative hearing. The existing workers' compensation hearing docket has a large backlog of cases to be heard, and it now takes several months to obtain a formal hearing and decision. This delay can be expensive for all parties involved. Effective, good faith mediation should reduce the number of disputes requiring a formal hearing. Mediation has proved an effective dispute resolution tool in state and federal courts, family and small claims court, and the environmental court.

TYPE OF PERSONS AFFECTED: Injured workers, employers including the State of Vermont and worker's compensation insurers, insurance adjusters, mediators, workers' compensation attorneys, and the Department of Labor.

COST BENEFIT ANALYSIS: The rule should reduce the overall costs of the workers' compensation dispute resolution process. The cost of mediation is to be split by the parties involved in the mediation.
