Long-Term Care Insurance Regulation.

Vermont Proposed Rule: 09P015.

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration.

CONCISE SUMMARY: This new rule will replace and repeal BISHCA Regulations 91-1. H-2009_01 helps to promote the availability to long-term care insurance coverage, to protect applicants from unfair or deceptive sales or enrollment practices, to facilitate a public understanding and comparison of long-term care insurance coverage, to facilitate the flexibility and innovation in the development of long-term care insurance, and to support consumers of long-term care insurance in attaining and maintaining their highest level of functioning in the most independent and least restrictive setting..

TYPE OF PERSONS AFFECTED: Those who will affected by this rule include: insured consumers, long-term care insurers, and long-term care insurance producers..

COST BENEFIT ANALYSIS: The proposed regulation contains numerous consumer protections designed to ensure that companies are selling suitable products that contain appropriate disclosures so that consumers understand what they are purchasing. Health insurers will incur some costs to develop and file products that comply with some of the heightened standards and reporting requirements; however, insurers will benefit from stronger customer relations and informed consumers. In addition, H-2009-01 requires producers selling long-term care insurance to complete training requirements specified to long-term care insurance; this requirement should not have a significant economic impact, however, because these courses count toward the twenty-four (24) hours of continuing education required in 8 V.S.A. § 4800a..
