PROPOSED STATE RULES

Underground Storage Tank (UST) Rules.

Vermont Proposed Rule: 09P016

AGENCY: Natural Resources, Environmental Conservation

CONCISE SUMMARY: This is an update of the existing Underground Storage Tank Rules (effective August 1, 2007). These rules mirror Federal regulations and are a major factor in EPA's delegation of the program to the State. The rule regulates the installation and operation of underground storage tank systems that store gasoline, diesel fuel, heating oil, kerosene, used oil, and other hazardous materials. These materials have great potential to affect human health and the environment, and the rules serve to minimize the potential threat from the underground storage tank systems. The 2009 changes will clarify and update several sections, and add a new requirement for operator training, which is now required under federal law.

TYPE OF PERSONS AFFECTED: Underground storage tank owners and operators at commercial facilities are affected by this rule. In addition, municipalities, state government (BGS, DPS, AOT), and a small number of school systems are affected, since these entities may own underground tanks.

COST BENEFIT ANALYSIS: The 2009 amendments to the UST rules will result in additional costs to facility owners, primarily due to the new requirement of operator training. Class C Operators will have to complete a training that involves 7 - 10 segments that take 60 - 90 minutes each, totaling approximately 7 - 15 hours. These extra costs may be partially offset, however, by the fact that trained tank operators should be able to recognize problems earlier, which should result in reduced spill cleanup and tank system repair costs.

Moose Management Rule

Vermont Proposed Rule: 09P017

AGENCY: Natural Resources, Fish & amp; Wildlife Dept.

CONCISE SUMMARY: Establishes criteria for implementing, controlling and enforcing a Moose Hunting Season.

TYPE OF PERSONS AFFECTED: Hunters, landowners, hunting equipment and supplies merchants, general store owners, lodging owners, F&W Department personnel, travel and tourism personnel, professional foresters, birding organizations, and hunting clubs.

COST BENEFIT ANALYSIS: If all permits are sold and auctioned, the benefits to small businesses are estimated to be at lest $1,285,500 (U.S. Fish and Wildlife Service Annual Survey). Costs to the Department of Fish and Wildlife for administration and enforcement of the hunt is estimated to cost $75,000 (printing, postage, equipment and labor). Benefits from the sale of moose permits and applications is estimated at over $350,000.
