Medicare Supplement - Insurance Minimum Standards Regulation

Vermont Proposed Rule: 09P022

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: In order to comply with federal law, this rule amends current rules regulating Medicare Supplement Insurance Standards.

TYPE OF PERSONS AFFECTED: Medicare Supplement Insurance purchasers, Medicare Supplement insurers, Department of Banking Insurance, Securities and Health Care Administration.

COST BENEFIT ANALYSIS: No significant economic impact is anticipated.

SCHEDULED HEARINGS: No public hearing is scheduled.

Hot Lotto

Vermont Proposed Rule: 09P023

AGENCY: Vermont Lottery Commission

CONCISE SUMMARY: This rule will establish the Hot Lotto game in Vermont. Hot Lotto is operated by the Multi-State Lottery Association, of which Vermont is a member. Hot Lotto is a five (5) out of thirty-nine (39) plus one (1) out of nineteen (19) on-line lottery game, with an option called Sizzler that is a prize multiplier. Hot Lotto is drawn every Wednesday and Saturday. The Grand Prize is paid, at the election of the player made in accordance with these rules or by a default election made in accordance with these rules, either on an annuitized pari-mutuel basis or as a cash lump sum payment of the total cash held for this prize pool on a pari-mutuel basis. Except as provided in these rules all other prizes are paid on a set cash basis.

TYPE OF PERSONS AFFECTED: Lottery players, licensed retailer agents, Vermont Lottery Commission and the State of Vermont Education Fund.

COST BENEFIT ANALYSIS: The economic impact to the categories of people, enterprises and government entities affected by this rule will include: 1) Players (cost = game play @ $1 / play) (benefit = potential win), 2) Agents or retailers (cost = no cost as VLC provides all materials to use in marketing of game) (benefit = 6.0% of sales, an increase to agents of approximately $120,000 in year one, plus potential of 1% bonus for selling a winning ticket over $500, capped at $30,000), 3) Vermont Lottery Commission (cost = 10% of sales to on-line vendor) (benefit = expected net profit of $600,000 for year 1 of game), 4) State of Vermont Education Fund (cost = no cost) (benefit = increase in amount sent to fund from VLC, expected at a net $600,000 in year 1). The above figures are based on historical sales data from other Hot Lotto states, including the experience of our neighboring state of New Hampshire. These figures have been reviewed by the Multi-State Lottery Association, and our on-line vendor, Scientific Games.

VOSHA rule: Personal Protective Equipment (PPE) Amendment.

Vermont Proposed Rule: 09P024

AGENCY: Dept. of Labor

CONCISE SUMMARY: OSHA is amending its standards to add language clarifying that the personal protective equipment (PPE) and training requirements impose a compliance duty to each and every employee covered by the standards and that noncompliance may expose the employer to liability on a per-employee basis. The amendments add no new compliance obligations. Employers are not required to provide any new type of PPE or training, to provide PPE or training to any employee not already covered by the existing requirements, or to provide PPE or training in a different manner than that already required. The amendments simply clarify that the standards apply to each employee.

TYPE OF PERSONS AFFECTED: Construction and General Industry employers and employees in the Public and Private Sector where PPE is required.

COST BENEFIT ANALYSIS: Any economic impact will be negligible because the amendments add no new compliance obligations. Employers are not required to provide any new type of PPE or training, to provide PPE or training to any employee not already covered by the existing requirements, or to provide PPE or training in a different manner than that already required. The amendments simply clarify that the standards apply to each employee.
