2009 Antlerless Deer Rule

Vermont Proposed Rule: 09P028

AGENCY: Natural Resources, Fish & Wildlife Dept.

CONCISE SUMMARY: The rule is intended to facilitate the scientific management of Vermont's white-tailed deer resource. Deer permits allow for the regulated harvest of deer. By doing so the state is able to maintain the size of the deer population at a level that is both ecologically consistent with long-term forest habitat health and provide the people of Vermont with a satisfactory level of deer related activity (e.g., hunting and viewing). The 2009 proposal includes an additional early muzzle loader season that would allow for four consecutive days commencing on October 29, 2009 and concluding on November 1, 2009 a person to take one white-tailed deer by muzzle loading firearm.

TYPE OF PERSONS AFFECTED: Hunters, landowners, hunting equipment and supplies merchants, general store owners, lodging owners, Fish and Wildlife Deparment personnel, Travel and Tourism personnel, professional foresters, birding organizations, and hunting clubs.

COST BENEFIT ANALYSIS: Economic studies conducted by the US Fish and Wildlife Service in 2006 documented $44,115,123 in total economic benefits from deer hunting in Vermont. The Department of Fish and Wildlife will incur approximately $85,000 in printing, licensing, education, and law enforcement costs associated with deer hunting. The Department will receive approximately $3.1 million dollars in license fees and revenues.

SCHEDULED HEARINGS: In accordance with 10 V.S.A. § 4081(f), five regional deer meetings were held: on March 24, 2009 in Springfield; on March 24, 2009 in Lyndon: March 25, 2009 in Manchester; March 26, 2009 in Montpelier; and March 30, 2009 in South Burlington. Four additional meetings will be held: June 3, 2009 Lyndon Institute Auditorium, 1 College Road, Lyndonville; June 4 Hartford High School, 37 Highland Avenue, Whiter River Junction; June 8 Bellows Free Academy, 71 South Main Street, St. Albans. The June 17 Rutland High School 22 Stratton Road, Rutland will be a public hearing.

Rule Governing the Establishment of All-Terrain Vehicle Use Trails on State Land

Vermont Proposed Rule: 09P029

AGENCY: Natural Resources; Forests, Parks & Rec.

CONCISE SUMMARY: Establishes a process by which a trail traveling over state land may be designated for use by All-Terrain Vehicles (ATVs).

TYPE OF PERSONS AFFECTED: Agency staff, ATV users, gneral store owners, lodging owners, Travel and Tourism personnel, users of state lands.

COST BENEFIT ANALYSIS: As the current 600 mile Vermont All-Terrain Vehicles Sportsman's Association (VASA) ATV trail system grows, ATV sales could increase, as well as an increase in business being felt by motels, gas stations, restaurants and general stores by additional ATV riders coming to a particular area, requiring goods and services that these businesses provide. Registration fees, as well as revenue generated from additionally insured ATVs, would also increase. Potential negative economic impacts could be felt by the state in terms of: additional staff time being focused on managing the ATV use of public lands; possible demands on law enforcement; additional impact on the trail system could increase maintenance costs.

SCHEDULED HEARINGS: A public hearing will be held in the auditorium of the Pavilion Office Building, 109 State Street in Montpelier, Vermont, from 7:00 p.m. to 9:00 p.m on Monday, June 15, 2009.
