PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Environmental Administrative Penalty Rules

Vermont Proposed Rule: 09P031

AGENCY: Natural Resources, Environmental Cons.

CONCISE SUMMARY: This rule updates the existing environmental penalty rule to allow for the imposition of larger penalties for Class II - IV violations. The proposed rule change also corrects an error in the existing rule, better defines economic benefit and adds a Class IV violation to better address de minimis violations.

TYPE OF PERSONS AFFECTED: This rule affect anyone (person, corporate entity, governmental entity) who violates Vermont's environmental law, a rule, or an issued permit.

COST BENEFIT ANALYSIS: The economic impact of this rule is twofold; environmental violators could be assessed a larger penalty, and de minimis violators (new Class IV) will be more equitably penalized for their conduct.
