PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Administrative Rules for Board of Dental Examiners

Vermont Proposed Rule: 09P036

AGENCY: Secretary of State, Office of Professional Regulations

CONCISE SUMMARY: Four of the Administrative Rules are changed. 1)Rule 4.2 "Licensure by Examination" will allow applicants for dentist licenses a broader selection of approved examination. 2) Rule 4.11 is retitled. New Rule 4.12 incorporates language from 26 V.S.A. § 810 which added continuing education to renewal requirements. It does not change the law. The four rules following 4.12 Part 4 are renumbered. 3) Rule 6.7 which permits licensure of dental hygienists by endorsement from states with standards that are not substantially equivalent to Vermont's is repealed. 4) The change to Rule 6.7 required a slight change to Rule 6.2 to show that, upon adoption, there will be only two routes, not three, to licensure as a dental hygienist.

TYPE OF PERSONS AFFECTED: The examination rule will affect only prospective dentists and may save some of them money. The dental hygienist rule will affect only applicants for licensure from the State of Alabama who have not attended CODA approved schools. All other states are considered to have substantially equivalent licensing standards.

COST BENEFIT ANALYSIS: The continuing education rule has no economic affect. The examination rule may lower the cost of obtaining a license in Vermont. The dental hygienist rule change will have no economic impact on licensees or the public, only applicants from Alabama who have not attended a Commission on Dental Accreditation (CODA) approved school and will not be able to be licensed in Vermont.
