PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. The public notices for administrative rules are now also available online at http://vermont-archives.org/aparules/ovnotices.htm The law requires an agency to hold a public hearing on a proposed rule, if requested to do so in writing by 25 persons or an association having at least 25 members.

Special Education Rules

Vermont Proposed Rule: 09P037

AGENCY: Dept. of Education/Board of Education

CONCISE SUMMARY: The following are the intended outcomes of this proposed revision: A. Revision of rules to conform with the US Department of Education's additional regulations for the Individuals with Disabilities Education Act (IDEA) that went into effect on December 31, 2008. B. Reorganization of the rules to be consistent with the federal format. C. Correct any instances where Vermont rules surpass the requirements of state and federal statutes and regulations. The proposed rules are available on the Department of Education website at http://education.vermont.gov/new/html/board/rules.html

TYPE OF PERSONS AFFECTED: Parents of children with disabilities and school district / supervisory union staff will be affected by this rule.

COST BENEFIT ANALYSIS: With the exception of costs associated with the formal rulemaking process, there are no anticipated increases in local cost associated with these rule changes. The rule allowing parental revocation of consent for special education has the potential to decrease special education expenses.

SCHEDULED HEARINGS: Written comments will be accepted and three public hearings via Vermont Interactive Television will be held. September 22nd 4:30 - 6:30PM at the Middlebury, Newport, Waterbury, and White River Jct. sites; September 24th, 9:00 - 11:00 AM at the Bennington, Johnson, Montpelier, Springfield, and St. Albans sites; and September 25th 3:15 - 5:15 PM at the Brattleboro, Lyndonville , Rutland, Waterbury, and Williston sites.
