Term Probation Midpoint Review

Vermont Proposed Rule: 09P038

AGENCY: Human Services, Dept. of Corrections

CONCISE SUMMARY: This proposed rule sets forth a Departmental review, during the month prior to the midpoint, of every probationer serving a specified term of probation. At this review, DOC staff may recommend discharge, a reduction in the term, or continued supervision with no changes, based on the probationer's progress toward completion of their conditions.

TYPE OF PERSONS AFFECTED: Corrections, probation and parole staff; victims and their families; court staff; State's Attorneys; criminal defense attorneys; law enforcement agencies; and offenders and their families.

COST BENEFIT ANALYSIS: Currently there are approximately 3200 offenders on probation who meet the criteria of this rule who are under the supervision of the Department of Corrections. This costs between $100 to $4,750 a year, depending on how the probationer is supervised by the Department. This rule will reduce the time on probation for offenders affected by this rule, who successfully complete their conditions of supervision. While this rule will reduce the number of offenders under supervision, there will be an increased cost to the courts, as there will be a need for review and possible court hearings that would not be necessary if the cases were to expire without intervention from the Department.
