PROPOSED STATE RULES
By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Procedure and Criteria for Obtaining an Exemption from the Sex Offender Internet Registry.
Vermont Proposed Rule: 09P042
AGENCY: Human Services, Dept. of Corrections
CONCISE SUMMARY: This proposed rule sets forth the criteria and procedures for determining how the Commissioner or Corrections will review exemptions to the Sex Offender Internet Registry for offenders who are eligible, after the Sex Offender Review Committee has ruled on the petition.
TYPE OF PERSONS AFFECTED: Victims and their families, sex offenders and their families, Department of Corrections staff, Department of Public Safety staff, Department of Children and Families staff, sex offender treatment providers, Court staff and local and state law enforcement agencies.
COST BENEFIT ANALYSIS: The Department of Corrections will be required to conduct reviews of a significant number of offenders, necessitating the time of administrative staff for record checks, documentation review, and interpersonal and collateral communication. This rule will subsequently increase the duties and tasks of the Sex Offender Review Committee as it reviews cases and makes recommendations to the Commissioner of Corrections. There will be an impact on the Department of Public Safety as it is the responsible department for maintaining the Sex Offender Registry. There also could be court hearings when a sex offender disagrees with the decision of the Commissioner.
SCHEDULED HEARINGS: Tuesday, November 3, 2009 from 12:00 pm - 2:00 pm in the Chapel Conference Room in the Waterbury State complex, and Wednesday, November 4, 2009 from 4:30 pm - 6: 30 pm at the Burlington Probation and Parole Office on 50 Cherry St.
