Energy Efficiency Standards for Appliances and Equipment.

Vermont Proposed Rule: 09P043

AGENCY: Department of Public Service

CONCISE SUMMARY: This rule establishes minimum efficiency standards for certain products sold or installed in the state.

TYPE OF PERSONS AFFECTED: Vermont Electric and gas utilities; Residential, Commercial, and Industrial appliance consumers; appliance retailers, distributors and manufacturers; heating equipment installers, electrical contractors; the Department of Public Service; the U.S. Department of Energy; and the Office of the Attorney General.

COST BENEFIT ANALYSIS: These standards help reduce unnecessary energy waste by requiring that certain energy-consuming products meet minimum energy-saving performance levels. By saving energy, these standards save consumers and businesses significant amounts of money over the life of the affected equipment, more than offsetting the incremental costs of the equipment. The standards will reduce pollution and also improve electric system reliability.

Rule 10.0000 Attorney Fees and Costs; Attorney Liens In Workers' Compensation Cases

Vermont Proposed Rule: 09P044

AGENCY: Dept. of Labor

CONCISE SUMMARY: Vermont statute requires the department to periodically update the permissible attorney fee level. The level has not been raised since 2001. This rule would adjust that fee level.

TYPE OF PERSONS AFFECTED: Injured workers, their attorneys and Workers' Compensation (W.C.) insurers will be directly affected by the Rule. If the increased fee causes an increase in W.C. loss costs, employers will see an increase in W.C. premium costs.

COST BENEFIT ANALYSIS: The proposed increase may result in a very small increase in W.C. insurer loss costs, but it is not anticipated that this increase will appreciably effect W.C. premiums. The increase should decrease the amount of attorney fees that an injured worker who prevails in a W.C. dispute is currently paying out of his or her W.C. award, and require the losing insurer to bear more of that cost.
