Rule on Rulemaking

Vermont Proposed Rule: 09P045

AGENCY: Office of the Secretary of State

CONCISE SUMMARY: The proposed amendments to the Rule on Rulemaking include removal of the filing forms from the rule to facilitate responses to statutory changes in the APA process. The amendments also include several housekeeping changes to clarify the process.

TYPE OF PERSONS AFFECTED: This rule will affect all state agencies, boards and commissions that adopt rules through the Administrative Procedures Act, and the general public.

COST BENEFIT ANALYSIS: This rule will have a minimal economic impact.

Health Insurance Claims Administration Rule

Vermont Proposed Rule: 09P046

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: This rule will establish a process for the creation of uniform standards for patient invoices, explanation of benefits forms, and Insurer Identification Cards.

TYPE OF PERSONS AFFECTED: Health insurers, health care facilities and providers, and all individuals who receive care in the health care system. The State of Vermont will be affected for all State run or funded health plans.

COST BENEFIT ANALYSIS: The economic impact of this rule is minimal. As standards are developed and implemented initial compliance with the standards may have associated costs. Initially there will be some start up expenses, which have been taken into consideration when drafting this Rule. The measurement of cost savings following implementation is difficult to calculate at this time.

Annual Financial Reporting

Vermont Proposed Rule: 09P047

AGENCY: Dept. of Banking, Insurance, Securities & Health Care Administration

CONCISE SUMMARY: The Regulation will update existing annual financial reporting and audit requirements for insurance companies doing business in Vermont. The new regulation provides the detailed mechanism by which the Department may continue to monitor and evaluate insurance company finances for solvency. The Regulation will specifically require filing of standardized annual audited financial reports, establish auditor qualifications and independence, and require disclosure of material weaknesses and other internal financial controls by insurance companies.

TYPE OF PERSONS AFFECTED: Insurance companies and the Department of Banking, Insurance, Securities and Health Care Administration.

COST BENEFIT ANALYSIS: Adoption of this new rule is not expected to have any fiscal impact on the Department or other state agencies or local government. Insurers are not expected to incur any additional costs in light of the consistency of this regulation with those implemented in other states and with federal law. Exemptions in the proposed rule are available for those insurance companies that do not exceed certain minimum premium thresholds while consistency with the regulations adopted in other states will promote efficiencies for insurance company reporting.
