Dog, Cat and Wolf-Hybrid Spaying and Neutering Program and Fund
Vermont Proposed Rule: 09P049
AGENCY: Agriculture, Food & Markets
CONCISE SUMMARY: This rule makes changes to the existing dog, cat, and wolf-hybrid spaying and neutering program that provides income eligible Vermonters with financial assistance for certain veterinary costs associated with the permanent sexual sterilization of their household pets. The amendments add clarity, flexibility, and operational efficiencies to the existing program, add an avenue of appeal to comport with basic due process for denied applicants, and implement a mandated eligibility restriction imposed by the Legislature in 2009.
TYPE OF PERSONS AFFECTED: Agency of Agriculture, Food and Markets, participating veterinarians, eligible low income Vermonters with unsterilized dogs, cats or wolf-hybrids as household pets, humane societies and animal shelters.
COST BENEFIT ANALYSIS: Household pets that were acquired for compensation are no longer eligible for sterilization. The amendments also give the program flexibility to gradually increase the co-pay amount from the current $25 per animal, if deemed necessary for program viability and by no more than $2 each year, up to a maximum of $35.00 per animal. Although increases in co-pays impact income eligible Vermonters, they also increase the number of eligible Vermonters who may receive Program benefits. The amendments off-set the co-pay increase impact, in principle, by allowing the Agency to develop a sliding co-pay scale for income eligible families with multiple pets that need sterilization. The program still provides a significant discount on veterinary services for eligible Vermonters. The flexibility to increase co-pay amounts helps the program retain participating veterinarians.

Regulated Drugs Rule
Vermont Proposed Rule: 09PE16
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: The effect of this rule will be to change all current references to the "recommended individual therapeutic dosage" to "benchmark unlawful dosage" in the Vermont Department of Health Regulated Drugs Rule. This change will allow the language of the rule to remain consistent with that of the statute. The Legislature changed the language "recommended individual therapeutic dosage" to "benchmark unlawful dosage" in 18 V.S.A. § 4234 as of July 1, 2009.
TYPE OF PERSONS AFFECTED: Persons, agencies and other entities involved in the regulation, oversight, possession, selling and distribution of regulated drugs.
COST BENEFIT ANALYSIS: There will be no economic impact to this amendment.

Regulated Drugs Rule
Vermont Proposed Rule: 09P050
AGENCY: Human Services, Department of Health
CONCISE SUMMARY: The effect of the rule will be to make permanent the emergency rule which replaced all references to the "recommended individual therapeutic dosage" to "benchmark unlawful dosage" in the VDH Regulated Drugs Rule. This revision allows the language of the rule to remain consistent with that of the statute (18 V.S.A. § 4234), that the legislature changed in Act 25 of 2009 by substituting "benchmark unlawful dosage" for all references to "recommended individual therapeutic dosage". The statutory change became effective on July 1, 2009.
TYPE OF PERSONS AFFECTED: Persons, agencies and other entities involved in the regulation, oversight, possession, selling and distribution of regulated drugs. Including, law enforcement agencies such as Department of Public Safety (DPS) State's Attorneys, Attorney General's Office (AG) and the defense bar and licensing and certification authorities such as the board of medical practice and board of pharmacy.
COST BENEFIT ANALYSIS: There will be no economic impact to this amendment.
