PROPOSED STATE RULES


By law, public notice of proposed rules must be given by publication in newspapers of record. The purpose of these notices is to give the public a chance to respond to the proposals. Vermont Wetland Rules (Proposed revisions to VWR text and to Vermont Significant Wetland Inventory Maps).

Vermont Proposed Rule: 10P001

AGENCY: Vermont Natural Resources Board, Water Resources Panel

CONCISE SUMMARY: These proposed revisions include a statewide update of the Vermont Significant Wetland Inventory (VSWI) maps, a private petition to reclassify a wetland near Balentine road and RT. 14 in Calais as Class I / II, and an update of the Vermont Wetland Rules (VWR) to conform to recent statutory changes. Pursuant to Act No. 31 of 2009, these VWR changes will establish a more efficient wetland reclassification process at the Agency of Natural Resources for most wetlands (Class II and Class III wetlands), and protect significant wetlands not yet on the VSWI maps. The proposed VWR changes also update certain technical definitions and provisions on wetland functions and values; provide for future VSWI map updates; update the individual and general wetland permit processes; expand allowed uses; and conform the VWR with changes in the law, effective in 2005, that transferred authority for the VWR from the former Water resources Board to the Water Resources Panel. Exemptions for agricultural and silvicultural activities remain unchanged.

TYPE OF PERSONS AFFECTED: Developers and builders, including those from the private sector, municipalities and state agencies; the environmental community, Agency of Natural Resources (ANR), the Natural Resources Board (NRB), Vermont Agency of Transportation (VTrans) and Agency of Agriculture Food and Markets (AAFM).

COST BENEFIT ANALYSIS: the impact should be neutral. There may be some increased costs at ANR and for some private developers, which should be offset by the efficiencies of the new administrative process.
